In terms of the provisions embodied in the Public Trustee (Powers and Function) Act [Cap, 31 R. E. 2002] the Administrator General is vested with powers to administer all unclaimed properties after being satisfied that the owner or the body corporate responsible for the said property is no longer into existence. Pursuant to the same law, the Administrator General is also responsible for protection and administration of the shares/properties of a child under the age of 18 years where there is no any relative or guardian responsible for taking care of the interests of the said child.            

The Public Trustee Act, (Powers and Function) Act;  Appointment has identified and mentioned the Administrator General as the Public Trustee.

1: Without Court Appointment

  • Pursuant to Section 5 (1) (a) of the Public Trustee Act the Administrator General as a Public Trustee has a power to administer any unclaimed property without being appointed by the court.
  • Also in terms of Section 23 (1) and (2) of the Trustees Incorporation Act, [Cap 318 R.E. 2002] the Administrator General, having revoked any trust incorporation under this provision has a power to hold and administer the properties of the said trust on the reasons set therein.

2: With Court Appointment

Under Section 5 (1) (b) and 7 of the Public Trustee (Powers and Function) Act, the Administrator General as a Public Trustee may apply in Court of competent jurisdiction to be appointed as a trustee to administer unclaimed property or a trust property whose incorporation has been revoked or  a property of a child under 18 years. The following are procedures:-

  • The Administrator General having been aware of the existence of unclaimed property or a minor under 18 years shall inform the Attorney General
  • The Attorney General shall lodge a Petition in Court for the Administrator General to be appointed a Public Trustee to administer a trust property under Public Trustee Act.
  • The Public Trustee shall be appointed to administer a trust property under Public Trustee Act.
